1. Nature of Service & Disclaimer
Nutrition analysis and dietary suggestions from Delemma are for reference only and do not constitute medical advice. Consult a healthcare professional before changing your diet or starting any health plan.
2. Data Collection & Use
• Apple Health data: daily aggregated summaries (step counts, heart rate averages, sleep duration, etc.) are encrypted and synced to your account; raw sensor data is never uploaded and never sold to third parties.
• Food photos: used for AI food & nutrition recognition. Processed first by Delemma's own AI (self-hosted). When our own AI is temporarily unavailable, a photo may be sent to a third-party AI provider (Anthropic, PBC) as a fallback. Photos are used only for that analysis, processed instantly and not permanently stored, never used to train third-party models, and never sold or used for ads. You are asked to consent in-app the first time you use these features.
• Chat history & nutrition data: encrypted in your account; never sold to third parties.
3. AI Limitations
Delemma's nutrition analysis is AI-powered and may contain errors. Treat results as reference only.
4. User Responsibility
If you have chronic conditions, consult your physician before adopting any dietary plan from this app.
5. Age Requirement
This app is for users 18 years and older.
6. Terms Updates
When terms are updated, you must re-confirm before continuing to use the app.
7. Feature-Specific Notices
• Nutrition Analysis & Advice: AI estimates vary by food type, portion, and cooking method. For reference only — not medical advice.
• AI Food Recognition (Camera / Nutrition Label Scan): Angle, lighting, and portion size may affect accuracy. Please verify results. Photos are processed first by our own AI; if it is unavailable, a third-party AI (Anthropic) may process them as a fallback (see Section 2).
• AI Text & Voice features (Delemma Flux voice assistant, AI Dietary Evaluation, Supplement Recommendations): all processed by Delemma's own AI (self-hosted); their text content is not sent to any third-party AI provider.
• AI Dietary Evaluation: Based on daily logged data. For reference only; consult a doctor for health conditions.
• Apple Health Data: Daily aggregated summaries synced to your encrypted account; raw sensor data never uploaded. Delemma is not responsible for data accuracy.
• Delemma Flux (Voice AI): AI assistant, not a licensed nutritionist. Advice is not medical guidance; biometric data accuracy is not guaranteed.
• Supplement Recommendations: Based on nutrition intake data. Not medical advice — consult a physician or dietitian before acting.
• Hydration Tracking: Based on manual user input. Delemma is not responsible for logging accuracy.
• Fasting / Keto Diets: For conditions such as diabetes, heart disease, or kidney disease, explicit medical approval is required.
• Pregnancy & Breastfeeding: Nutrition targets auto-adjust per DRIs 2023 and WHO/ACOG guidelines. For reference only — follow your doctor's guidance.
8. SMS & Messaging
8.1 Purpose: When you provide your mobile phone number to Delemma, we may send you SMS text messages (and, when you choose, supplement them with a voice call). SMS messages include:
• Registration verification codes — to verify your phone number when creating an account;
• Login verification codes — for identity verification when signing in;
• Number-binding verification codes — to link a phone number to your account;
• Forgot-password / password-reset verification codes;
• Account emergency / security alert verification codes (for example, an unusual sign-in);
• Diet or nutrition reminders sent by your designated nutrition coach;
• A very small amount of marketing / promotional messages.
8.2 Consent: By entering your phone number in the Delemma app and tapping "Send code," you consent to receive the SMS messages above. Verification-code messages are transactional and sent on demand; reminder and marketing messages are sent only when the corresponding feature is enabled.
8.3 Frequency: Message frequency varies by your usage (codes are triggered by your actions, reminders per your settings, and marketing is very infrequent).
8.4 Rates: Message and data rates may apply, charged by your mobile carrier.
8.5 Opt-out & Help:
• Reply STOP / UNSUBSCRIBE / CANCEL / END / QUIT / STOPALL / REVOKE / OPTOUT to opt out of ALL Delemma SMS sent to that number. Please note: under U.S. carrier and Twilio rules, opting out applies to the entire number and includes account-service messages such as verification codes — transactional messages cannot be kept separately, so after you opt out that number will no longer receive any Delemma SMS (including sign-in, registration, number-binding, and password-reset verification codes).
• To resume after opting out: reply START (or UNSTOP / YES) to resubscribe; or switch to email sign-in; or, after adding another sign-in method to your account, unbind this phone number, or close your account.
• Reply HELP / INFO for assistance. Message and data rates may apply.
8.6 Privacy: We use your phone number only for the purposes above and do not sell or share your phone number with third parties for their own marketing. See our Privacy Policy for details.
9. Third-Party Sign-In (Apple & Google)
9.1 Methods: In addition to email and phone, Delemma lets you create an account and sign in with Sign in with Apple or Sign in with Google.
9.2 Information we receive: When you sign in with Apple or Google, we receive your name (where provided), your email address, and a unique account identifier from the provider, solely to create and authenticate your Delemma account. With Sign in with Apple you may choose to hide your email address (Apple private relay), and we will use the relay address. With Sign in with Google we receive your basic profile (name, email, and profile picture).
9.3 What we do NOT receive: We never receive your Apple or Google password — authentication is performed entirely by Apple or Google. We do not access any other data in your Apple or Google account (such as contacts, files, calendar, or Drive). We do not sell or share this information with third parties for their own marketing.
9.4 Provider terms: During third-party sign-in, your information is also handled under Apple's and Google's own privacy policies. Delemma's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
9.5 Your control: If your account has more than one sign-in method, you may unbind a third-party login at any time in the app, or delete your account entirely, which removes the associated data per our deletion process.
